New Hampshire Pre-Licensure Education Requirements
New applicants for a New Hampshire must complete 20 hours of prelicensing training approved by the NMLS. The NMLS approved education totals 20 hours, with 3 hours on federal law, 3 hours of ethics (which shall include fraud, consumer protection, and fair lending issues), 2 hours of non-traditional mortgage lending, plus 10 hours of undefined education (referred to as electives) + 2 hours of NH law. Number of hours is 3/3/2/10 + 2 hours of NH law = 20 New Hampshire has a requirement for 2 hours of instruction on state-specific law which may be satisfied by either taking a NH comprehensive course or a state-specific elective course. Start by getting your 20 hour course and passing the national component exam, THEN do state specific training after passing the exam.

New Hampshire Continuing Education Requirements
Every state-licensed MLO (in any approved status) is required to complete at least 8 hours of NMLS approved education annually beginning the year they are licensed (unless PE was completed in the same year). Annual CE education must include 3 hours of Federal law, 2 hours of ethics (which shall include fraud, consumer protection, and fair lending issues), and 2 hours of non-traditional mortgage lending, plus one additional hour of undefined education (referred to as an elective). Number of hours is 3/2/2/1 = 8 Click here to get your 8 hour SAFE Comprehensive CE Course MLOs are advised that to comply with the SAFE Act’s “successive years” rule, they may not take the same CE course two years in a row. MLO’s are advised not to retake pre-licensure education (PE) unless directed to by a State Regulator. PE education does not count towards meeting annual CE requirements.

Deadline
The deadline to complete CE is December 31, 2022. However, MLOs in New Hampshire are prohibited from submitting an application to renew their license if they have not completed CE. Since it may take as long as seven (7) days for a course provider to report a course completion into NMLS, MLOs are strongly encouraged not to wait until the last minute to try to complete CE or they may be prevented from submitting for renewal on time.

Who has to be licensed in NH as an MLO NH Processor?
This license is required for all individuals who for direct or indirect compensation or gain or in the expectation of direct or indirect compensation or gain, takes a mortgage application or offers, negotiates, solicits, arranges, or finds a mortgage loan or who assists a consumer in obtaining or applying to obtain a mortgage loan by, among other things, advising on loan terms (including rates, fees, and other costs), preparing loan packages, or collecting information on behalf of the mortgage loan. A sole proprietor licensed as a mortgage broker, mortgage banker or mortgage servicer shall also obtain a license as a mortgage originator prior to engaging in the activities of a mortgage originator. A branch manager of an office required to be licensed in New Hampshire must also be licensed as a loan originator. A loan processor or underwriter who is an independent contractor.
No individual may act as an originator for more than one mortgage banker, broker or mortgage servicer.

Temporary Authority
On March 15, 2018, Congress passed the Economic Growth, Regulatory Relief and Consumer Protection Act (S. 2155), which included a new provision under the SAFE Act of 2008 (The “Safe Act”). This new provision, known as Temporary Authority to Operate for Mortgage Loan Originators, preempts New Hampshire RSA 397-A:5, IV-c (b). The New Hampshire Banking Department will be operating under this new provision of the SAFE Act beginning November 24, 2019.
